What California Law Says About Shoplifting

Shoplifting is defined under Penal Code 459.5 as entering a commercial establishment during regular business hours with the intent to commit larceny, where the property taken or intended to be taken is valued at $950 or less. That definition has three elements the prosecution must prove: that you entered an open business, during regular operating hours, with the intent to steal. The charge doesn’t require that you actually left the store with merchandise. The intent to steal must have existed at the moment of entry.

Proposition 47, passed by California voters in 2014, created shoplifting as a distinct lower-level offense, separating it from felony burglary. A person charged under Penal Code 459.5 can’t also be charged with burglary or theft for the same property. However, if the alleged theft involved property valued above $950, or if the entry occurred after hours, the conduct may fall under grand theft (Penal Code 487) or burglary statutes instead.

Penalties & Consequences of a Shoplifting Conviction

Most shoplifting charges under Penal Code 459.5 are charged as a misdemeanor, carrying up to six months in county jail and a fine of up to $1,000. That exposure increases for defendants with certain prior records. A prior conviction for a serious or violent felony, or for an offense requiring sex-offender registration under Penal Code 290, can result in felony shoplifting charges with penalties that may reach three years and a $10,000 fine, depending on the circumstances. Proposition 36, approved by California voters in November 2024, added another escalation path: a defendant with two prior convictions for shoplifting or related theft offenses may face felony charges under certain conditions. These thresholds depend entirely on an individual’s prior record and the facts of the current case.

Beyond the criminal case, retailers may pursue a separate civil demand letter under Penal Code 490.5, seeking up to $500 in recovery costs regardless of whether charges are filed or a conviction follows. That letter is a civil matter, independent of any criminal proceeding.

Depending on the situation, first-time offenders may be eligible for a diversion program. These programs typically require completing conditions such as restitution, community service, or an anti-theft class in exchange for dismissal of the charge. Eligibility varies by prior record and the specific facts involved.
