Testing, Impairment, & the Traffic Stop Can Shape Your Defense

A drug DUI charge often turns on evidence different from that used in an alcohol-only case. California Vehicle Code section 23152(f) prohibits driving under the influence of a drug, but detecting a substance doesn’t by itself establish that the substance impaired a person’s ability to drive safely. We handle felony and misdemeanor DUI matters involving prescription medication, over-the-counter medication, cannabis, and controlled substances.

The prosecution may rely on driving behavior, officer observations, field sobriety testing, statements, blood or urine results, and laboratory interpretation. Allegations involving both alcohol and drugs require additional scrutiny of which substances were detected and how the prosecution claims they affected the driver.

Evidence We Examine in a Drug-Impaired Driving Case

Our review begins before the chemical test. We examine the reason for the traffic stop, the length and scope of the detention, the observations supporting the arrest, and whether any search or biological sample collection complied with constitutional requirements.

Important parts of a DUID investigation may include:

  • Officer observations: Reports concerning speech, balance, coordination, pupil size, behavior, and alleged driving conduct
  • Video evidence: Dashcam or body-camera footage that can be compared with the written report
  • Field sobriety testing: Instructions, testing conditions, physical limitations, fatigue, footwear, and the officer’s scoring
  • Blood or urine testing: Collection timing, reported concentration, chain of custody, laboratory methods, and the substance or metabolite identified
  • Medical information: Prescriptions, dosage information, medical conditions, and therapeutic use relevant to the allegations

A test result may require careful interpretation. Collection timing, the properties of the identified substance, and the other evidence of driving can affect what the result does or doesn’t establish. Forensic toxicology may also be relevant when evaluating conclusions about a drug and its alleged effects.
