When a California DUI Becomes a Felony

Most DUI arrests are filed as misdemeanors. Three circumstances change that. First, a fourth DUI offense within 10 years triggers felony classification under Vehicle Code 23550. Second, any driver with a prior felony DUI conviction faces felony charges on any subsequent DUI committed within 10 years of that prior conviction, under Vehicle Code 23550.5. Third, a DUI that causes injury or death to another person is charged under Vehicle Code 23153, a wobbler offense that prosecutors frequently file as a felony when injuries are serious or a prior record exists.

When a death results, the charge can escalate further. Prosecutors may file gross vehicular manslaughter while intoxicated under Penal Code 191.5 or, in cases where a defendant had a prior DUI conviction and received a Watson advisement, second-degree murder under the Watson murder doctrine. That doctrine holds that a driver who was previously warned that drunk driving can kill has implied knowledge that can make a fatal DUI potentially chargeable as murder.

Prior convictions used to elevate a charge to a felony must generally fall within the preceding 10 years, and not every past conviction automatically qualifies. Whether a given prior actually counts is something we examine at the outset of each case.

Penalties for a Felony DUI Conviction

A felony DUI conviction in California can result in a state prison sentence, with the exact term depending on circumstances such as prior convictions or whether the offense caused injury, along with thousands of dollars in fines. A DUI causing injury carries additional consequences, including longer ignition interlock device requirements. Repeat offenders convicted of a felony injury DUI can face installation periods of up to 48 months.

The DMV process runs on its own clock. After a DUI arrest, you have 10 days to request a DMV Administrative Per Se hearing to contest the automatic license suspension. That deadline runs independently of anything happening in criminal court. Missing it can forfeit your right to challenge the suspension administratively.
