California Underage DUI Rules & BAC Thresholds
Blood alcohol concentration (BAC) measures the percentage of alcohol in a person’s bloodstream. For drivers under 21, a result below the adult 0.08% threshold can still lead to license consequences or an allegation under California law. The applicable provisions depend on the driver’s age, test result, alleged impairment, and testing circumstances.
California law distinguishes among several alcohol-related issues:
- Vehicle Code section 23136: California’s zero-tolerance rule applies when a driver under 21 has a BAC of 0.01% or higher. Depending on the facts and procedure, the DMV can impose a one-year license suspension.
- Vehicle Code section 23140: A driver under 21 with a BAC of 0.05% or higher can face an infraction with consequences separate from the zero-tolerance license action.
- Conventional DUI allegations: A young driver may also face prosecution based on alleged impairment, a higher BAC result, drugs, or a combination of alcohol and drugs.
A preliminary alcohol screening is a roadside breath test used to estimate alcohol concentration. Other evidence may include a later breath or blood sample, an alleged refusal, officer observations, and field sobriety exercises. Each piece of evidence must be considered in the context of the specific allegation.
Steps to Take After an Underage DUI Stop
The paperwork issued after a stop may contain separate deadlines for driving privileges and court proceedings. According to the California DMV, a request for an administrative hearing generally must be made within 10 days of receiving the suspension or revocation order. Missing that deadline can affect the driver’s opportunity to challenge the administrative action.
Keep the following materials available for review:
- The citation and any release paperwork
- The suspension order or temporary license
- Breath, blood, or preliminary alcohol screening documents
- Vehicle tow or property receipts
- Notices showing the court date and location
Follow the instructions on each official notice. A DMV decision doesn’t automatically resolve the court case, and a court result doesn’t necessarily determine the separate license proceeding. We can review both tracks during the free consultation.
